General Terms and Conditions
1. Scope of application
The business relationship between Christoph Paulus (Seller) and the Buyer shall be governed exclusively by the following General Terms and Conditions, hereinafter referred to as “GTC”. Any provisions deviating from these GTC shall only apply if confirmed in writing by the Seller.
2. Offer and conclusion of contract
All offers are subject to change and non-binding. A contract is only concluded by written order confirmation or by invoice. All prices include the statutory VAT of 19%.
3. Payment and default
Payments are due within 14 days. The ordered goods will not be delivered until the amount due has been received in full. Payment is made in advance (bank transfer), SEPA direct debit (via Stripe), PayPal or credit card (via Stripe). For PayPal and Stripe payments, the fees incurred are passed on to the buyer. These are calculated as follows:
PayPal: EEA 2.99 %, Great Britain 4.28 %, rest of the world 4.98 % + 0.39 Euro
Stripe: EEA 1.5 %, UK 2.5 %, rest of the world 3.25 % + 0.25 Euro
4. Revocation
You can revoke your contractual declaration within two weeks without giving reasons in text form (e.g. letter, fax, e-mail) or – if the goods are delivered to you before the deadline – by returning the goods. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods not before receipt of the first partial delivery). The timely dispatch of the revocation or the goods is sufficient to comply with the revocation period. The revocation is to be sent to:
Christoph Paulus
Friedhofstraße 9A
52393 Hürtgenwald
Germany
Phone: +49 (0)171 9627068
E-mail: info@cockpit-concept.de
Consequences of revocation
In the event of an effective revocation, the services received by both parties shall be returned and any benefits derived by us (e.g. interest) shall be surrendered. If you are unable to return the goods received in whole or in part, you may have to compensate us for the value. You do not have to pay compensation for the deterioration of an item. Goods that can be sent by parcel post are to be returned at our risk. You have to bear the costs of the return shipment if the delivered goods correspond to those ordered. Otherwise the return shipment is free of charge for you. Items that cannot be sent by parcel post will be collected from you. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your declaration of revocation or the goods, for us with their receipt.
Special notes
The right of withdrawal does not apply to deliveries of goods that are manufactured according to customer specifications or are clearly tailored to personal needs. It also does not apply to data carriers if they have been unsealed by the consumer.
Your right of withdrawal expires prematurely if the contract has been completely fulfilled by both parties at your express request before you have exercised your right of withdrawal.
5. Delivery and shipping costs
Delivery within Germany is carried out by Deutsche Post DHL, outside Germany by its respective partner.
The costs for packaging and shipping are calculated according to the destination country and weight and displayed in the order overview.
Please note that, depending on the destination country, additional costs may be incurred that cannot be predicted exactly. These can be, for example, customs or other duties on import. Please enquire about the possible costs in your country before sending an order.
6. Withdrawal by the seller
The seller is entitled to withdraw from the contract for good cause until the services have been rendered. If the seller withdraws from the contract for good cause, the price will be refunded to you immediately via the payment method selected by the buyer when placing the order.
7. Liability
The seller’s liability under the contract is limited to intent and gross negligence.
8. Data protection
Data processing is carried out in accordance with the Federal Data Protection Act. All customer data is only collected, processed and used insofar as this is necessary for the establishment and execution of the contract.
The customer has the right, upon request and free of charge, to receive information about the personal data stored about him by the seller. In addition, he has the right to correct incorrect data, block and delete his personal data, provided that there is no legal obligation to retain it.
9. Applicable law
The law of the Federal Republic of Germany shall apply. The UN Convention on Contracts for the International Sale of Goods is expressly excluded.
Should individual provisions of the GTC be invalid in whole or in part, the remaining provisions shall remain unaffected. The invalid provisions or parts thereof shall be replaced by the respective statutory provisions.
